Can there by any conviction and punishment in 498a case? Prevention?
05-Apr-2025 (In Divorce Law)
Me and my wife went to a trip and there we had an verbal argument. Because of that on returning to our home my wife packed her bag and tried to leave home at 9 pm. Then we had another argument and I tried to stop her. At that point of time she slapped me twice and on response of that I slapped her once. I have the complete audio recording of the incident. Later my wife came back and blackmailing me that she'll file 498a case against me. In such case, will I be convicted and get punishment?
There is no need to worry about if she filed an FIR under 498A, but yes, on the basis of this FIR, one case will be initiated against you. One thing you have to be carefully noted is that she may file 3 or 4 cases against you except 498A 1. maintenance, 2.divorce, 3. domestic violence, etc.
conviction under 498A is very much hard to prove at the time of the trail of the case.
That depends on evidences .. but in most of the cases evn in 99percent cases acquitted .. but if she lodged an FIR u have to be surrender before the court and take bail in the preliminary stage that’s necessary.. then after producing the chargesheet the trial will start..for more details please connect in WhatsApp or in call
hello, u can file a GDE at first for ur safety, and if ur wife filed an FIR regarding 498 then u can take bail from court, and after bail the procedures will start. there are many processes to start the trial. all are impossible to write here. so any further guidance kindly call me, thank you
