Can sister ask for divorce if her husband is mentally disabled

my sister got married in 2015 but the boy is mental he get an mental attack after 3 months when he takes more tension but his family did not informed us that their son is having the high level depression problem before marriage now my sister has delivered a baby girl which is 4 months now my sister want a divorce from him we have ask the doctor his report but the doctor denied to give his report

Hi you can file divorce on other ground including his illness but not only on 1 ground of mental problem. Now you can file on ground of cruelty from your husband and his parents. Simultaneously you file for maintenance.

Your sister can file for Divorce but if on grounds of unsound mind then she has to prove that it is to such an extent that the petitioner cannot reasonably be expected to live with the Respondent.And if you want file on grounds of fraud then it has to be within one year of the discovery of the fraud .

Your sister can proceed before family court for divorce under the ground that her husband is unsound mind.
She can also claim maintenance and other rights regarding the dispute.

Yes, your sister can take the ground that her husband is suffering from mental disorder and seek divorce on this basis. When the matter will be conducted, this fact will have to be brought on record by providing evidence. You can get orders from the court directing the doctor to provide the report.

Dear sir, you can file diverse application in the court on the ground of her husband is mental . There is a provision in law .if doctor denies to give you document you can send him summons from court .
