Sir after 7 years of love I married my girlfriend. Six month back she was leaving me n going to bangalore. She is the not ready to stay with me n did not give divorce. I m a farmer n she has a job .I can't reject her. BT she was. How to handle it. Sometimes she says to give divorce to me. Sometimes did nt give .Sir can I send a notice to my to my wife
Instead of sending legal notice you can directly file a divorce case in the family court if you really want to divorce your wife or if you want your wife back you can also file a case for restitution of conjugal rights.

If you want to divorce your wife, file a divorce petition under Section 13 1(1a) of Hindu Marriage Act,1955 in the jurisdictional family court where your marriage was solemnized OR where you both last resided together before she left you abruptly. No need to send any notice to your wife prior to filing for divorce. The court will send notice to her asking her to appear before it and contest the divorce petition filed by you. However, if want to live with your wife and want her to rejoin you, you can file a petition for Restitution of Conjugal Rights (RCR) under Section 9 of the Hindu Marriage Act, 1955 in the jurisdictional family court where your marriage was solemnized OR where you both last resided together before she left you. Once you file the Restitution of conjugal rights, in general, there will be a mediation procedure which might help in resolving your problem as is the case in many cases.

When you married that girl? Do you have any proof? What is your age? What is her opinion to stay with you? If she is not willing to stay with you then what is the use of make her force . You speak to her parents. First ask her why she is not interested stay with you. Then proceed accordingly. First you can send a legal notice to come back and continue marital life.
Then you can file a case in the court for RC rights. But what is the use if she is not willing. Counselling is required. If not worked out then go for close the issue by mutual understanding.
