Can i re marry without getting divorce

Dear Sir/Madam, I am priya ,married on 2012,i have a one girl baby(5 yrs),My husband left me alone on 2013. still we both don't have any contact. Any chance to re marry without divorce.Please guide me.Even i don't know where he is ?...My age is 26 ..My parents worried lot about my life ...Please help me what need to do for this.We Both didn't register our marriage.Its done in simply temple.no invitation card .

You can't go for it . Once he comes out suddenly after your marriage he can file case against you and your family for bigamy .. so it better get divorce ..on the ground of desertion .. please do contact me for further details

As you have a child from your husband it is always better to take divorce and remarry. In future he may come and ask for the custody of child or file case against your second husband on the ground of adultery and void marriage etc. He can prove through DNA test that your daughter is born to him and you are his legally wedded wife. Hence, give an missing complaint and advertisement in newspaper after waiting for a while you can marry.

You can always file for a divorce and get divorced as an exparte if your husband does not turn up for more than 3 to 4 proceedings of the court.
Also, if you don't have sufficient proofs of the marriage you can definitely go ahead with your marriage but what happens if your present husband comes back and claims to be married. So, it's always advisable to get your divorce done legally.
