Can i get stay on Divorce case proceedings until 498a is closed?

24-Mar-2025 (In Divorce Law)
I initially filed for Separation in 2021. But after they have filed a false 498a case on me, I filed for a divorce. The baseless allegations on me and smear campaign done by them is a very big factor in the harassment i had faced by them. Under this circumstance, can i approach the high court for a stay on divorce case until 498a judgement in given?(since it will prove that they filed fake cases).

Yes, you can approach the High Court to request a stay on the divorce case until the 498A case is decided, arguing that the outcome of the criminal case is crucial in proving your claims in the divorce proceedings. However, the court’s decision to grant a stay depends on several factors. Legal Considerations: Stay on Divorce Proceedings: You can file a petition under Article 227 of the Constitution of India before the High Court, seeking a stay on the divorce case, citing that the 498A case is crucial to establish the truth and prevent prejudice. Courts may not usually stay civil matters (divorce) for criminal proceedings (498A), but if you can show that the 498A case outcome will directly impact the divorce case, the High Court may consider granting a stay. Impact of the 498A Case on Divorce: If the 498A case is false and gets dismissed, it will strengthen your case in the divorce proceedings by proving that you were falsely implicated and harassed. You can use this to argue for mental cruelty and even claim damages for false prosecution. Alternative Approach: Instead of seeking a complete stay, you can request the family court to defer certain parts of the divorce proceedings (such as evidence and cross-examination) until the 498A judgment is given. You can also file for quashing of the 498A case in the High Court under Section 482 CrPC if you have strong evidence of false allegations. Steps to Proceed: Consult a lawyer to draft a stay petition under Article 227. File the petition in the High Court, citing grounds for harassment and the direct impact of 498A on your divorce case. If the High Court denies the stay, continue both cases simultaneously, using the 498A dismissal (if it happens) as strong evidence in the divorce case. Would you like a draft format for the stay petition?
