Can i get my marriage annulled ?

I got married 3 years ago with a girl and 3 months ago i came to know she was already married with someone else and did not get divorce.
under section 12(c) False misrepresentation. It states that we can file the case only within 1 year of marriage.
I have searched for the answer everywhere but could not find a clear answer. Please help me clarifying this. We have no children and we have been living as husband and wife since marriage.
for null and void you can file case within one year of marriage is mandatory you can file null and void on the ground of non consummation of marriage and other Grounds available for null and void. you must state what reason you are sitting for null and void

you are liberty to file for a contested divorce petition under section 12c of the Hindu Marriage Act. however it would be e your responsibility to prove the existence of previous relationship are the marriage in a way that is convincing for the court to decide. you may get the proof of marriage other from where place of marriage or a photograph or any certificate issued by Marriage Hall or Samaj.
