Can I file Nullity/Void marriage against my husband ? married 5 months

Marriage on 15 july 2024,My husband before marriage lied about his behaviour as He is very calm person and matured and will be supportive. and he agreed to some of my conditions before marriage.But post marriage I can see a different person who is very aggressive and touches my private pars without my consent when im unconscious and fights all the time. on these bases can I go for nullity on fraud or file for divorce ??

Dear client, based on your question, if your husband abuse you this is the group of divorce of Cruelty. you can file contested divorce under section 13 of Hindu Marriage Act, 1955. before file divorce, it would better to consult an advocate. hope this advice help you. for details discussion feel free to contact.

unfortunately your finding your husband being now a different person than what he appeared to you before you agreed to marry him is neither a grand for filing nullity nor for divorce. you have to wait for one whole year before you consider for separation.

I understand your questions so you want to file a nulity of marriage with in 5 months marriage right. yes you have a right to file the section 12 of hindu marriage Act . and seeking the divorce before court you have ri fallow the section 12 of hindu marriage Act

Dear Sir, Your grounds for nullity of marriage is insufficient you cannot establish your case. Normally, divorce cannot be filed within one year of marriage except there are exceptional grounds like your husband had first wife or in he is suffering from abnormal medical ailments and not on behavioural grounds.
