Can I File Divorce Petition Now!?

I have filed maintenance case,dv case,498 a case against my husband.My husband and his family have received summons long time back... But they have not yet appeared in the court taking benefits of the pandemic situation in Maharashtra.. They belong to other states.. They have not replied to the notice of police yet..Fir also filled on 14/08/2020.. They have not come for mediation at women cell.. How I can hope that matter may resolve in mediation as he had not shown any interest to resolve the issues before any authority...or before any friends and relatives...So please guide me, should I apply for divorce at this stage or should I wait till he appears and file reply in all the cases filed at various courts...!?

hi

in this case be clear that each and every case that you filed is under different provision of law therefore proceedings under those laws will go accordingly.

though divorce case is correlated to other cases it has different entity and will be tried seperately.

therefore it is advisable that you should go ahead for divorce

You should first have to understand that all the delays are going only because of this pandamic situation. If you can wait for few months, then courts will work in full fledged way. You can issue notice to them for interim maintenance through court. Even if you will move for divorce Petition it will take time. If by mutual consent things go ahead then take alimony and close this chapter.

madam I read your matter in detail . you have been filed of 498cases also because of covid-19 lot of matters pending with various authorities and court also . therefore adverse order will not b pass against your husband . but there is no bar file case divorce at present hands you can consult with me immediately for filing the divorce case .
