Can I apply mutual Divorce due to mental stress and want to know ab?

29-Jul-2023 (In Divorce Law)

Have been married for 7years. Have a son (2yrs). Relationship was never good for long time. He is giving mental stress due to which I once attempted suicide. Can I apply for mutual divorce and is it possible to take over the custody too?

Mutual divorce will be possible only when your husband agrees for divorce. Otherwise you have to divorce petition and your husband will contest. Based on the facts and evidence divorce may be granted.

Hello mam sure you apply for mutual divorce and to take over the child custody also . because the hindu act say son Or daughter any child before the age of 8 years mother only natural guardian. so you apply the mutual divorce mam.

consent petition you should decide all these things the custody of the child and the visitation rights of each party and the maintenance of the wife and the maintenance of the child and education and what are the things put at the time of marriage articles and jewels everything should be decided earlier and you should come forward for mutual consent maintenance which can be finished with in 20 days
