Can I apply Judicial Separation

30-Apr-2023 (In Divorce Law)
Hello Sir,nMy wife left matrimonial home for simple reasons so i sent legal notice with my lawyer to reunite but my wife applied for RCR. Now i have asked my lawyer to dismiss the fake RCR case appliede by my wife and file a new RCR case since i have all the proof that only my wife left the matrimonial home. My lawyer has advised to file a Judicial Separation case so that my wife would return back without extending the RCR case. Can you please suggest if Judicial Separation case is valid on this scenario. As of now I don't want divorce but if my wife filed divorce i'm fine with it.

you should not wait until your wife apply for divorce. if you are having full need to reunion then file the counter in that rcr and get reunion. if you are not willing to reunion then left the case where you left

It is an unthoughtful and wrong move by your wife. First you had sent legal notice to your wife for reunion. Then why did she file the petition for restitution of conjugal rights. Legal notice was sent earlier by you and your wife's motive to show that she has been ready for reunion will not materialize. And legal notice for reunion and now petition for judicial separation are opposite to each other.
