Can husband withdraw mutual divorce petition in second motion
14-Sep-2024 (In Divorce Law)
Is it ok to withdraw mutual divorce petition during second motion , as I signed that document because my wife created scene in my home and because of parents force I agreed to mutual divorce.
She filled 498a , I want to withdraw on second motion and want to fight DV case ,
can I request judge appearing in second motion for alternative residence towife instead of matrimonial house , currently she stays in her parents house , just to create pressure she is saying she will come and stay with me
Dear Sir,
You have every right to withdraw from the mutual divorce process due to the ugly atmosphere created by your mother. You may take a separate house and ask your wife to stay with you. Also request the court to give back your amount towards alimony if any is paid. Oral submissions may not be considered. Get file an application under relevant provision of law and file it.
