07-Jul-2023 (In Divorce Law)
Is it possible that judge dismiss the 498 (a) case ongoing in the court since 2013 if the girl who has filled the case remarries to other person in 2015 after getting Talaq from previous husband on whom 498 (a) was filed?

No. As the 498 A is criminal case the case cannot be withrow or dissmiss after divorce. The accused has to be gone through the proceeding of the court. The girl may settle the matter via becoming hostile ( say no for allegation made by her) and the accused can be aquitted but he has to gone through all proceedining.

Remarriage by the lady cannot be a ground for dismissing the complaint under Section 498A. If the girl does not attend the court for her deposition then you may request the court for the same. ...
