Came to know about husband's Schizophrenia after 8 years of marriage

Mine is love come to arrange marriage. My husband behaviour was always different and violent sometimes. I recently came to know he had Schizophrenia before marriage. We have a house joint ownership but EMI and Down payment are done by me. Want to know how I can be processed with Divorce and what need to prepared

If you have his medical reports that he is suffering from mental illness and if it is beyond curable nature, you can apply for anullment of marriage under the provision of HMA . You can move an application before family court for annulling of marriage as your husband is suffering from schizophrenia prior to your marriage and was concealed to you at the time of fixation of marriage, which amounts to fraud thus you can apply for nullity of marriage. Instead of divorce you can go for annulment of your marriage on the ground of his schizophrenia which he did not disclose before marriage. In that case status of your marriage itself will be null and void and yours also won’t be a divorcee. You can file acivil suit showing details of the payment you made and ask for his bame to be removed from the property.

you will need to file for divorce on ground of mental instability of your husband which you came to know after 8 years if your marriage...once the case is filed , court will need a certified doctors report to the same effect. ..in the meanwhile you should consider admitting your husband into a rehabilitation center
