Questions Answered by Advocate Aniket Bhosale

Q: Partition of ancestral property

Can a suit for partition of property be filed in Karnataka for a property in Kerala

Advocate Aniket Bhosale answered
Perused your query. If the holding property is ancestral property then father in law can transfer the property upto the extend of his share. And daughter in law holds coparcenery right in the ancestral property. Thus she can claim her right in the property. In case if the property is self acquired property of father in law, he have every right to dispose off the property in any manner as per his desire. So nature of property is very crucial, whether it is self acquired or ancestral.

Q: Came to know about husband's Schizophrenia after 8 years of marriage

Mine is love come to arrange marriage. My husband behaviour was always different and violent sometimes. I recently came to know he had Schizophrenia before marriage. We have a house joint ownership but EMI and Down payment are done by me. Want to know how I can be processed with Divorce and what need to prepared

Advocate Aniket Bhosale answered
MadamIf you have his medical reports that he is suffering from mental illness and if it is beyond curable nature, you can apply for anullment of marriage under the provision of HMA . You can move an application before family court for annulling of marriage as your husband is suffering from schizophrenia prior to your marriage and was concealed to you at the time of fixation of marriage, which amounts to fraud thus you can apply for nullity of marriage. Consult a local lawyer and get the clear picture.

Q: My Lawyer Told Me To Write Self Story For Divirce Case How To Write

How do I write self story for divorce case need to give lawyer

Advocate Aniket Bhosale answered
sir/madam. As per my understanding your lawyer must have told you to write your story i.e. exact facts of your matter which brings you towards the decision of divorce. In order to make your case strong even minute details will prove helpful. So you are suppose to give the true facts as a true story and not the the manipulated one. Further you can clear your communication with concern advocate.
