Broke marriage after engagement girl family threatening to file case

Our family belongs to Aryasamaj who believes in Vedic tradition. Hawan was performed at my engagement with all engagement rituals and after that both party girl and boy exchange Flower garlend similar to Jai-mal. After breaking enagegent , Girls side are making false allegation that you have done all rituals before Saptpadi which is not truth. No rituals marriage rituals happened at engagement and now they are saying we will file a case in court for that . This is complicated but tell me what they can do in future.?

The pre requisite of a valid hindu marriage is the Saptapadi (seven steps). If they have evidence (video or pictures) to show that all rituals of marriage have been performed, gift have been exchanged then they may have a case against you but in your case Saptapadi was not performed. Check if they procured any marriage certificate or theres any entry in the register of the priest. It is unlikely that they would succeed in showing a valid marriage between you two.

However, breaking of engagement in which many rituals were performed (perhaps rings exchanged) and expenses meated out would definately attract many legal provisions and give advantage to the other party in filing of cases against you.


1.They may sue you, inter alia, for compensation on account of expenses incurred.
2. They may sue you for breach of promise and claim damages.
3. May file criminal complaint for cheating etcetera.

Whatever may be the reason for the break up, it is advisable to reconcile with the other party and part ways amiably.
One can always mitigate the higher cost of litigation with pre litigation compromise.

Since there is o marriage solemnised between the boy and the girl according to the Hindu Marriage Law, there does not seems to be a problem; hence, it's tought they will be able to establish the marriage before the Court. In any case, if they are able to get notices issued to you from the Court, you may bring it to the notice of the Court that such case is not maintainable for there was no marriage at first place.
