Dear Madam, If you do not create forcible circumstances your marriage with him never happened. It seems he is not serious in getting marry you. If this situation continues he definitely marry another girl as may be settled by his parents. If necessary threaten to lodge or lodge complaint with Police and immediately get marry him.

Under Hindu law, marriage is a voluntary union between two consenting adults. If the person you were in a relationship with is now refusing to marry you despite earlier promises and physical involvement, it’s important to understand your legal position with clarity and emotional strength. A promise to marry followed by physical intimacy, and then sudden refusal, especially if you were misled with false assurances, can amount to cheating or breach of trust under Indian law. If you were induced into a physical relationship solely on the basis of a promise to marry, and he never intended to fulfil it, you may have grounds to file a criminal complaint under Section 376 (rape by deception), Section 417 (cheating), or Section 506 (criminal intimidation) of the Indian Penal Code. However, courts require clear evidence that the man never intended to marry you from the beginning and that the consent for the physical relationship was solely based on the false promise. If there was mutual affection and ongoing consent, and later he backed out under family pressure, the legal situation becomes more complex. You cannot force someone to marry you under law, but you can hold him accountable for emotional and physical exploitation if it amounts to fraud or deceit. Marriage under the Hindu Marriage Act requires free will from both parties. If he refuses, you cannot compel him to marry you, but if you were wronged, you can pursue legal remedies. At this stage, it is advisable to consult a family or criminal lawyer with all your messages, proof of relationship, and the timeline of events to assess whether a case can be initiated based on false promise to marry or other relevant provisions.
