Bought a home together , now separating

I and my husband are Hindu. I have been body shamed, forbidden to take care of my parents and restricted from doing job. We bought a home together where in I paid almost double amount than my husband in down payment. House is named after both of us but the loan is on my husband only. I have come back to my place after a lot of rift. He is not paying EMI. I am worried what if bank takes the house back since they aren't interested in knowing the personal issues and who paid more. What can I do to prevent getting the house being auctioned? I don't need the house but the money I invested in it.

You can send a legal notice to the bank for settlement and also file a mandatory injunction suit against your husband to repay the loan as he has been defaulted at his own end. For any further legal assistance please feel free to contact

Solution of your problem lies in a bitter fact that in order to save your investment and to set at rest the controversy in question, you have got to file a civil suit and initiate a matrimonial litigation in family court. Rest we will discuss when you will consult me professionally.

The issue of EMI being paid etc will have to be settled in case of divorce, at the time of settlement. The bank is not concerned with the family dispute but only with the emi, in case of default heavy penalty may be levied
