Betrayal mental torture and no support with regards to finance
28-Mar-2025 (In Divorce Law)
To start with my father in law gave a wrong impression of himself and his family and hid a lot of facts before marriage. Even my husband did not mention anything about the background of their family. Post marriage my husband was very ride towards me with mental torture and abuse along with his mother. After delivery of the child my husband never supported me. I was juggling with my job. household chores babycare and even finances. He never till date has given maintenance for his child
Based on your situation, you have strong legal grounds to seek relief under various provisions of law:
Domestic Abuse & Mental Harassment: Under the Protection of Women from Domestic Violence Act, 2005, you can file a case against your husband and mother-in-law for mental torture and emotional abuse. The law provides for protection, residence rights, and financial compensation.
Divorce & Legal Separation: If you wish to proceed with a divorce, you can file under Section 13(1) of the Hindu Marriage Act, 1955 (for Hindus) or under relevant laws based on your religion, citing cruelty as a ground.
Child Maintenance: As per Section 125 of the Criminal Procedure Code (CrPC), 1973, a father is legally bound to provide maintenance for his child. You can file a petition in Family Court demanding regular child support. Courts usually decide the amount based on the husband's income and financial capacity.
Financial Neglect & Alimony: Since you were solely handling finances post-childbirth, you may also be entitled to alimony (permanent or interim maintenance) under Section 24 & 25 of the Hindu Marriage Act, 1955 or under personal law applicable to your religion.
Hi,
I have gone through your story, it seems you haven’t mentioned after your story that what exactly you are looking for.
In my opinion you can file for Maintenance Sec 125 crpc, DV matter and also for Divorce matter.
You can also make a fresh police complaint against your in-laws and Husband under section 498A.
