Applying mutual consent for 2nd time

Hi, We had applied for mutual consent once and didn't appear in the court after 6 months. My husband had a fight with that lawyer. It was 3 years back. To apply again, is it a fresh start or is there any procedure to apply for change of lawyer? Thank you!

Yes you need to start in fresh. There is no procedure to change of the advocate since it will be the new case.

Dear madam, first you check status of previous case which filed for mutual, if that case is still pending, you can approach in the same case for divorce or if that case was dismissed as your husband was not appeared before court. you both has to file fresh case. in this case NOC from previous Advocate is not required, you can engage any advocate as you wish.

Hi you can file a fresh a petition seeking for the order recalling the dismissal of your case if that is so happened because when the case is filed and parites don't appear the cases get dismissed or you can file a fresh petition keeping new lawyer to do this both your earlier advoacte is not required there few procedures which the advoacte you enagage will have to follow.
