Q: B report of police rejected in district court for case u/s 498A

My wife filed a 498a and my 14 family members and after investigation police department have given B Final report saying that it's false case. Now my wife filed a protest petition against that report and rejected the B Final report submitted by police. please anyone help me to save my family from this case as all members are staying separately. what is b report ?

Hello Mr. firstly its good that police have filed a B report. if that is rejected upon your wife's protest petition the judge should either direct further investigation or himself start an enquiry by recording sworn statement of your wife. The B report filed by police would indicate that there is no evidence that you or family could be held responsible. what i would suggest is to approach high court challenging the rejection of B report and later if you do not succeed in it and proceedings or investigation resumes you also can file a 482 petition before high court for quashing of such proceedings in 482 if you can establish that your family or you are being victimised with false allegations you can certainly succeed.good luck:)

Hi, it would normally take a week to get anticipatory bail. However, if the matter is urgent, we can file for interim bail based on the severity of the issue. Sir/Madam, My name is Deepa, and I live in Bangalore. My husband sent me a divorce notice 4 months ago, and the case is ongoing in the family court. My lawyer is very careless and not supporting me properly. I have a 3.8-year-old son and am seeking maintenance, but my lawyer does not come to court on time and is not at all supportive. I want to change my lawyer. Please let me know the procedure to change lawyers in the middle of a case in India. Can I change lawyers in the middle of a case?

Hi, since you have a minor kid to take care of it is very much important that you are supported financially. Good that you have filed for maintanance. To change the present lawyer you need to take NOC from them or if your lawyer does not want give you NOC or otherwise you still can change lawyer by filling an affidavit of you with the vakalath of new lawyer before the court thereby making your intention of engaging the service of new lawyer at the place of old lawyer very clear to court.RegardsShridevi Bhosale

Q: Restitution of conjugal rights

My husband had a filed a restitution of conjugal rights in hyderabad.My husband native is hyderabad and i am from bangalore. We were married in blore and have a 6 years old daughter. He is in US right now.I am very much willing to join him but he is not ready to take me. He had filed the Restitution case for some other intention. Now the court passed the order saying that the petition is allowed and directed to join him with in 3 months of the order passed.1) when i checked the case status online it is mentioned as "Nature of Disposal: Contested--ALLOWED". What does this mean?2) The judge has passed the petition as i requested him that i wanted to join him. But now thing is that he is in US and he is not ready to take me over there. and even if i mail him , i am not getting any response from him. Can any one please please suggest what to do in this matter. I have a 6 year old daughter and i don't want her life to get spoil.I am totally tensed about this about how to proceed now.

Hi, So if you want to give a chance for saving marriage, you can file for restitution of conjugal rights and try or even try to talk to him and settle the issues before even going to court. In case of either of you chose to initiate court process and files a case , you even can settle the matter at court at a later stage too, as the courts will refer matters for mediation which is platform for any kind of settlement between you both.We can advise you better if we get to know the contents of his legal notice and reply to the same sent by and also upon understanding from you the actual problem in the marriage.Feel free to revert for any help regarding the same.Regards Shridevi Bhosale Advocate
