Yes, you can file maintenance petition under Section 125 of Cr.P.C immediately and get maintenance from the day you filed it. You must say to your Advocate that you are petition must accompany with a claim for interim Maintenance and your advocate must produce salary slip of your husband and your unemployment certificate.
