in your case, under which section file petition if you file sec 13. then other party present in your case and if file mutually then court give j a for 6 month then decided your matter. this depends upon only under which section you file petition

Now once you had filed divorce Petition so what you want that is important. Whether you wan to settle this matter amicably or you want to book him and his family under Domestic Violence Act. Also whether you want monthly alimony..What you want to do..decide first.
