Am i eligible for maintenance or not? and how long it will take ?

If wife wants to file for divorce on the basis of compatability issue, like abusive behaviour of husband (working in army), anger issues, not giving her monthly expense though the wife is self dependent. How much take it long to get divorced and will she get maintenance though the wife is working. In my case husband is asking for 22 lacs rupees, dowry was not given but the whole expense of marriage and engagement were taken care by bride's family.

To answer your query, it depends on how much your wife is earning. Does she have children of yours in her custody who she needs to take care of. All those factors will be taken into consideration. Also, how much you are earning. Divorce can be definitely filed, if it is a mutual divorce it should take upto a year, a little longer if it is contested. get married, don't ask for divorce or maintenance or separation because all this will ruin your life. the contesting divorce petition takes time . but in your case the husband is employed in Army he may fail to attend court and the court may grant you ex-party decree of divorce. Hire a good lawyer who knows the benefits of non presence of the other / opposite party.

Wife can claim the maintenance against her husband as the wife has right to live as the living standard of her husband and the rest part of maintenance case depend upon the circumstances and facts of the case. if you want more suggestions to me then you can contact me.

In this particular scenario, you can file a complaint at your local police station and subsequently you can file a DV Case, Maintenance case and also a contested divorce against your husband. The said cases will be filed simultaneously and if everything goes efficiently, it’ll take a year’s time to get all the cases disposed off. However, in these kind of cases, there are high chances that your husband may offer a settlement and if you agree with the said settlement, the case will be withdrawn on the basis of the agreement executed between both of the parties.
