Q: Am i eligible for maintenance or not? and how long it will take ?

If wife wants to file for divorce on the basis of compatability issue, like abusive behaviour of husband (working in army), anger issues, not giving her monthly expense though the wife is self dependent. How much take it long to get divorced and will she get maintenance though the wife is working. In my case husband is asking for 22 lacs rupees, dowry was not given but the whole expense of marriage and engagement were taken care by bride's family.

Advocate Depender Kumar answered
In this particular scenario, you can file a complaint at your local police station and subsequently you can file a DV Case, Maintenance case and also a contested divorce against your husband. The said cases will be filed simultaneously and if everything goes efficiently, it’ll take a year’s time to get all the cases disposed off. However, in these kind of cases, there are high chances that your husband may offer a settlement and if you agree with the said settlement, the case will be withdrawn on the basis of the agreement executed between both of the parties. Rest, in order to get a proper hold of your current situation, We’ll need to discuss the said matter at depth.
