Alimony not paid despite court order

06-Jan-2023 (In Divorce Law)
An office colleague has her divorce case in the Delhi district court. The court had ordered her husband for payment of maintenance in the year 2014. But the order was never executed and maintenance was never paid. She has two children and ageing parents to support with her paltry salary working with an ngo as computer operator. The summons sent to her husband's address in Bihar are returned with the comment that no such person of the name of her husband existed. Her current lawyer says she has to secure summons from a district court in Bihar and do the rest of procedure in that court. nPlease suggest a remedy for the poor lady.

You can always go for registration of FIR against your husband or in the maintenance case you can always file a execution petition for supplying of the maintenance amount till date. Or you can also send a arrest warrant from the court to hold catch of him. For more legal assistance I am just a call away.

Hi..!!! Being this an interstate matter, the lawyer correctly suggested that she has to secure the presence by taking the help of Bihar District Court. However, before that you can try with publication in the newspaper.

maintenance can be paid under various laws, like under secton 125 crpc, under domestic violence law, under hindu marriage act, etc. first you will have to find under which law was maintenance awarded. accordingly remedy will lie. if the husband is not obeying court order, then apart from execution proceedings, contempt of court proceedings also can be filed which is punishable with imprisonment.

Hello, if the lady has bank account details of her husband which she can obtain from her husband's income affidavit filed in court she can ask court to freeze the bank account and release the amount. for more information, feel free to have a word with me.

You can file the suit before the concerted court. After examining the case and listing the parties, the court will give the judgment in your favour. The only thing you have to do is to go to court and file the petition through your advocate. Yup
