20-Oct-2023 (In Divorce Law)
My husband got married before nd did not divorce his first wife. He applied for restitution of conjugal rights in 2013. I got married to him in a registered marriage in collector's office in 2019 I've got two kids with him. I want to know that if our marriage is valid and if no then can I ask for alimony from him

See if he did not divorce her first wife then second marriage will not be valid but you can seek alimony for yourself and your children by stating he falsely trapped you into this and later on you got to know about this.

According to hindu marriage act it is necessary for second marriage that the person who wants to do second marriage should be obtained decree of divorce otherwise the second marriage without having decree of divorce will be held invalid in the eyes of law. But if you wish to continue this marriage then your husband should file a petition for divorce against his first wife and obtain the divorce decree from the court. if you need alimony etc then you have to file a petition under domestic violence act. it is better to discuss this matter in detail with me on phone or visit to my office. you can get my contact details from the administrator of this website
