24-Feb-2023 (In Divorce Law)
After I suffered a lot, he is such a dominating person, I realize it after marriage. He never talks to me politely and softly. He is always an aggressive and irritating person. I couldn't tolerate his behavior and I run away from home after 25 days. I took the wrong step in my life. I want to correct it now. I want a divorce from my husband. But I do have not enough money right now. So, How can I proceed with my divorce procedure?

You can seek a divorce under section 13 of the HM Act considering you both are Hindu's. You need to consult a lawyer having expertise in matrimonial laws to clear your ambiguities regarding which legal recourse to take. Their are other options available as well like filing a complaint case under Domestic violence Act and a Section 125 Crpc Petition.

If the behaviour of your husband is intolerable towards you then rather then dragging your relationship you should file for divorce under cruelty grounds. I would suggest you to go for the mutual divorce as it is less money consuming and ends up in maximum of six months. For more legal assistance I am just a call away.

25 days are not enough to decide on divorce ! Please follow Reconciliation process ! Talk to your common friends & arrange social meetings! If things still don’t work out then kindly hire an advocate for next step ! Divorcé according to HMA 1955, has either contested divorce or Mutual! Furthermore, you also have options for Domestic Violence n 498a etc accordingly ‘ Plz b in touch

Divorce may be either a mutual divorce or a contested divorce. For mutual divorce, both husband and wife must agree to the mutual agreement between both of them and can go to the competent court of jurisdiction. On the other hand, for the contested divorce to be filed in the court of competent jurisdiction both husband and wife must be living separately for at least one year.
