Advise on divorce filing and knowing all consequences in legal manner

I need to file a divorce. Need to know what could be the possibile challenges. I need custody of my 19 months child. Plus I don't have a secure financial background and a property to live. So I want to ensure we get help there. As whatever my parents had went in my marriage. Reason to divorce - gaslighting, continuous mental harrasment, no bond as likely in normal couple, continuous ignorance and a lot which came from the in laws cashed severe damage to my mind. My mental health is lost.hindu

If the behaviour of your husband is intolerable towards you can anytime send a complaint regarding your grievances in writing to the police station according to your jurisdiction. And if you wish to go legal then you can also file a petition under section 12 DV or section 125 CrPC and claim maintenance for yourself as well as for your minor child. And if there's no scope of living together then rather stretching the relationship you should file for contested divorce under the ground of cruelty. I would suggest you to go with mutual divorce because it's cost effective and ends up in a maximum of six months. For more legal assistance I am just a call away.

you should file divorce petition for divorce,and you will get custody of your children, if you have no strong financial conditions you can file a maintenance case for maintenance yourself and your children ,the process is very simple to file

Are you the husband or wife. From wife's perspective you can file a divorce case along with that interim maintenance case along with regular maintenance case . Custody of child below 5 years always goes to the mother and you can also claim your streedhan back . Even domestic violence case results into compensation to be awarded

On the limited information shared, it is advised to seek divorce on the ground of cruelty as per Hindu Marriage Act. Also custody of the child can only be claimed by showing the best interest of the kid with you only. Welfare of the child is the paramount factor in child related cases. Hope you are doing great and in good health You need to decide first, if it's toxic relationship and no hope for future it's better to call it hope. my advise to you would be approach court with a proper representation of facts.
