Advice Required on a Matrimonial Issue

If a couple (Guy - Hindu, Girl - Christian) who were married however it was not legally registered neither in church or in court are separated for 10years without any contact, will that marriage be considered as legally nullified ? or is a divorce still required so the couple can move on and find a different life partner ?

okay I understood your issue you and you wife marrege 2yeares we took saparation you have to file divorce at court other wise but is not nullity if marriage it is not legal reason to marriage was nullity so you have file divorce understand Hindu marriage Act desertion ground and cruality you will get divorce from court

It depends it cannot be regarded as nullified directly. The evidence if produced by the wife. The question is if you have stayed together for a long time period before the separation. The Act does not make registration mandatory for considering marriage as valid. There are certain grounds if satisfied the marriage is regarded as valid.

Dear Sir, If any of the spouse is agreed then problem will arise if both of you agree to stay away and marry separately then they will be no issue for you. If you suspect and if there are any other public records in respect of your marriage and then go for mutual divorce. You will be in safer side.
