Ask the court to issue a warrant against the accused, Also if he is not paying you maintenance go for an execution case. You need to fight strong to receive maintenance and justice for you and your child.

1. If accused is not paying maintenance for the child as per a court order you can file a contempt of court application in the concerned Court. 2. if the accused does not appear on the due date of hearing the court can issue warrants against him to secure his presence. If the summons has been duly served upon the accused persons and thereafter deliberately they are not appearing the court can issue warrants against them. So far as non payment of maintenance is concerned, you can file an execution petition

File a contempt for maintenance case and file an appropriate application in the 498a case for apprising the court that the accused may abscond and a warrant must be issued. However, the court on its own makes order in such conditions.
