Dear Madam, Until you get divorce legally you cannot adopt a male child. Otherwise you have to take consent of your husband. Under two methods you can adopt a male child that is through CARA and by way of registered adoption deed of any male child from your kith and kin.

Yes, in adoption process the marital status is not given considerations. A single female can adopt a child of any gender. The age difference of child and parents shall not be less than 25 years. Procedures are firstly you need to register with an authorized agency Indian Placement Agencies (RIPA) & Special Adoptive Agency (SPA). Then there will be a home study and counselling. The social worker from the agency will have a visit to the home to do home study. They will also let you attend counselling. The agency will intimate the interested person when-ever they are ready for adoption, they will have medical report, physical examination and other information from you. Once the parents are comfortable with a child, they will have to sign a few documents pertaining to acceptance. The necessary documents are submitted to lawyer who prepares the petition to presented to court. Once the petition is ready, the adoptive parents will have to visit the court and sign the petition in presence of court officer. Once the petition is signed in court, the adoptive parents can take the child to pre-adoption foster care centre. The parents have to attend a court hearing along with the child. The hearing is held in a closed room with a judge. The judge may ask a few questions. Once the receipt of investment made is shown, the judge shall pass the adoptive orders.
