A husband is a gay..want to file case but husband is avoiding

As discussed earlier my husband is a gay which I came to know after two years of marriage. I approached lawrato lawyers for further steps to be taken but before we r trying to take further divorce step as he is in merchant Navy he is joining ship so he can avoid this for next 9 months..so wht strict action shld we take to stop him from joining

His presence will be required during verification rest either he appoint a POA or his lawyer take VIrtual hearings. Which mode of Divorce are you both planning to take?? Mutual consent or Contested??
Post covid Virtual hearings have become easier to proceed the matters.

Well, you can send a Legal Notice to your Hubby first, that, he cannot go to join his duty in Merchant Navy before seeking Mutual Divorce with you by filing a Divorce Petition in Court regarding it. If things won't work out after sending legal notice, then, you can seek court orders to retrain him from joining duty, so that, first he applies in Court to seek Divorce and then proceed forward with joining his duty.

Hello when the case of divorce petition is filed against your husband which is of civil in nature his presence before court is required only for chief and cross examination of the matter, if the court insists his presence he has to remain present either physically or through his lawyer, there is no strict provision to restrict him from joining his services
