What is the maximum time for filing Discharge App in MM Court

An FIR was filed against me in June 2024 and Chargesheet was filed in October 2024 is it possible to file a Discharge application now in MM court. What is the maximum time limit.

Yes, a discharge application can be filed before the Magistrate under Section 239 CrPC if sufficient grounds to proceed are absent. There is no strict time limit; it can be filed before charge framing. Kindly share details for proper assistance

Yes, you can file a Discharge Application even after filing of the Charhesheet on several grounds including lack of prima facie evidences against you in the concerned Metropolitan Magistrate Court. There is no maximum timelimit as such, before conviction, you can file Discharge Application at any point of time.

yes you can file a discharge application before MM court as chargesheet is filed but make sure no charge is framed against you till yet. The time limit to file a discharge application is before charges are framed against you once the charge is framed against you there will be a trial stage and discharge application is no longer possible to be filed
