Police not filing report in JMFC court


21-Jan-2023 (In Cyber Crime Law)
Fir & chargesheet is filed in JMFC court in I. T matter. (65A) But now police is not filing the report in court since last 3 years. I hv also filed discharge application. What are the relief to me as the case is not moving further coz of the report. I hv to go every date just for the sake of attendance. Can my case be discharged on this ground? Pls Suggest

Well, if we will able to convince the Judge, that, Police is intentionally not filing Chargesheet in your case since years, despite the fact, that, they could have completed their investigation much earlier, then they are high chances to seek Discharge for you and get your Criminal Case quashed.

Hello, if the case is warrant case then at appropriate stage only you can move discharge application and you have other remedy for filing a quashing of FIR petition under Sec 482 of CRPC before high court, once it is quashed your case ends.
