Cyber crimes are treated with utmost seriousness under Indian law by both the Police and the Judiciary. If you are a victim of any form of cyber crime, your first course of action should be to approach the nearest Cyber Police Station and file a formal complaint. The authorities are mandated to register your complaint and initiate a preliminary inquiry or investigation based on its contents. In case the police fail to take timely or appropriate action, you are entitled to escalate the matter by filing a petition directly before the Jurisdictional Magistrate or the Hon’ble High Court under relevant provisions such as Section 156(3) of the Code of Criminal Procedure, seeking directions for registration of FIR or investigation. Additionally, the Government of India has provided an online grievance redressal platform - Cyber Crime Portal, where you can register cyber crime complaints. This portal also offers a dedicated section for offences against women and children, ensuring a more sensitive and expedited handling of such cases. It is advisable to preserve all evidence such as emails, screenshots, and communication logs, and to consult with a legal professional to ensure proper representation and follow-up.
