Questions Answered by Advocate Upparapalli Shruthi (25+ answers)

Q: Gross negligence and Service delay by 30 days

What is the highest possible compensation I can demand from a refrigerator company for the mental agony, potential health risk concerns for me due to frustration and my kids due to outside food. (kids have a medical history of food allergy from outside food and junk foods), despite of my continuos efforts in following up? Not a single attempt was made in the 30 days to resolve the issue. Closed service requests without any technician visit or without my consent.

Advocate Upparapalli Shruthi answered
When a company fails to repair or replace a defective product—especially something essential like a refrigerator—and ignores repeated complaints, it amounts to clear deficiency in service and negligence. In your case, since it also led to mental agony, risk to your children's health (with medical history), and complete disregard for service timelines, you have strong grounds to claim compensation. There is no fixed upper limit—you can reasonably demand up to ₹10–15 lakhs or more, depending on the impact, medical background, and supporting evidence. The Consumer Commission will assess the claim based on actual loss, mental suffering, and conduct of the company. We can help you file a strong consumer case with detailed pleadings and evidence to ensure proper compensation and accountability.

Q: Received Anonymous mails in May 2021

Is it possible to find who sent anonymous mails?if so in how many days?

Advocate Upparapalli Shruthi answered
Yes, it is possible to trace the sender of anonymous emails through proper cyber investigation, depending on the email content, platform used, and technical details like IP address, server logs, and metadata. You need to file a cyber complaint with the police, and they will forward the request to the concerned email service provider. The time frame depends on how cooperative the platform is and the complexity of the case, but in general, initial tracking details can take a few weeks to a couple of months. We can assist you in filing a proper cyber complaint with all necessary details to initiate the process legally and correctly.

Q: Defective Gold Ornament and Unjust GST Charges on Replacement

Bought a gold ornament partially under their scheme (only 1/4 covered, rest paid in full) from CMR jewellers. The item was defective, but they refused exchange, making false excuses due to scheme terms of no exchange (but no where mentioned in the bill or scheme card) — even though most was paid by cash. They failed to repair the item after keeping it for 20 days. Later, agreed for exchange but with new bill and charging GST & stone cost again for a replacement, despite already paying for it.

Advocate Upparapalli Shruthi answered
This is clearly a case of deficiency in service and unfair trade practice under consumer law. If most of the payment was made in cash and the scheme covers only a small part, they cannot deny exchange or impose new charges like GST and stone cost again, especially when the defect is not your fault. Also, if the terms about no exchange were not mentioned anywhere in the bill or scheme documents, their refusal is not legally valid. You can take legal action to recover the amount you already paid and seek compensation for the inconvenience and harassment. We can help you send a strong legal notice and take this up before the Consumer Commission to ensure they are held accountable and your loss is recovered.

Q: Account Freezed due to suspicious transaction

Hi - My account was frozen due to a suspicious transaction, but I was never involved in any such criminal activities. When I approached the bank, they said that a cybercrime police officer suggested freezing my account. Bank officials provided me with an email ID and phone numbers to contact the Police where the complaint was raised. I tried multiple times to contact the provided numbers, but no response. I also tried to send an email, but it was not delivered. Please suggest.

Advocate Upparapalli Shruthi answered
Your bank account cannot be frozen without proper legal procedure, and you should have been informed officially. If the cybercrime police asked for the freeze, but you were never involved in any offence, and you’re unable to contact them, the next legal step is to file a formal complaint or FIR at your local police station explaining the situation. After that, we can help you file a proper application before the court to unfreeze your account. This needs to be done legally to protect your rights and avoid any further complications. Let us know—we can take this forward properly.

Q: Wrongful Rejection of Life Insurance Claim Under Secure Mind Policy

My father passed away in 2021 due to cardiac arrest following COVID-19 infection. He had an ICICI Lombard "Secure Mind" insurance policy linked to his home loan. Despite the death certificate citing cardiac arrest as the cause of death, the insurance company rejected the claim, stating it was due to viral pneumonia and a supposed pre-existing condition—which he never had.The policy was over 3 years old, and as per Section 45 of the Insurance Act, a claim can only be denied after 3 years in case

Advocate Upparapalli Shruthi answered
You have strong grounds to challenge the claim rejection, especially since the policy was active for several years and there’s no proof of any actual pre-existing condition. The insurance company’s reasoning appears weak, and we can help you take proper legal action to contest this—either by issuing a legal notice or filing before the consumer commission for wrongful denial and compensation. This type of case falls well within our expertise, and we can guide you through each step to ensure your rights are protected and the claim is pursued effectively.
