17-Oct-2024 (In Cyber Crime Law)
I am female, age- 27, I met a boy in University in 2016, we dated for 3 yrs. After 2 yrs of relation I caught him multiple times with proof for cheating on me but we didn't break up as he promised to not do so,but he cheated again and I lost my all feelings for him so I broke up and moved on. One year later I started dating someone else so he started blackmailing me since then till now. I blocked him but he contacts my family and friends on social media and defames threats abuses me
In your situation, it’s clear that you are dealing with harassment, defamation, and emotional abuse from your ex-partner. Here’s what you can do to protect yourself legally and emotionally:
Keep all the evidence of his blackmail, threats, abusive messages, and attempts to contact your family and friends. Screenshots, emails, messages, and social media posts can be used as proof.
Document the times he has tried to defame you or threatened you, as this will be crucial if you pursue legal action.
Since your ex-partner is blackmailing you and making threats, this falls under criminal behavior. You can file a First Information Report (FIR) with the police for harassment, blackmail, defamation, and cyberbullying (since he’s using social media).
Provide all the evidence you’ve gathered, including threats and defaming posts.
You can seek a restraining order (protection order) or injunction from the court to prevent him from contacting you, your family, or friends. This legal step will force him to stop any communication with you directly or indirectly.
If he is using social media to defame you, contact the Cyber Crime Cell in your city. Cyberstalking, defamation, and abuse through online platforms are illegal, and authorities can investigate the issue.
Most social media platforms also have reporting mechanisms, and you should report his profiles or posts for violating community standards.
You can file a civil defamation case if he is spreading false information about you to harm your reputation. This could potentially result in him being fined or ordered to pay compensation.
This type of harassment can take a toll on your mental health. Consider reaching out to a counselor or a support group to help you manage the emotional impact.
It’s important to seek the help of a lawyer who can assist you in navigating the legal system, whether it's to file a police complaint, pursue a restraining order, or take defamation action.
By taking these steps, you can protect yourself from further harassment and ensure that legal action is taken against your ex-partner. You have the right to live without fear and intimidation.
Your ex-boyfriend’s persistent harassment, including contacting your family and friends on social media and defaming you, qualifies as cyberstalking under Section 354D of the IPC, which punishes stalking through electronic means. His threats, blackmail, and abusive behavior also fall under criminal intimidation (Section 503 IPC), which addresses threats to harm reputation or loved ones. His defamatory remarks against you to others are punishable under Section 499 IPC, which criminalizes any act that damages reputation. Additionally, under the Information Technology Act, sending abusive and threatening messages via social media violates Section 66A, which covers offensive messages, and Section 67, which pertains to transmitting obscene content electronically. To address this, you should file a complaint with the nearest cybercrime cell, providing evidence such as screenshots and messages. You can also register an FIR under the relevant IPC sections and IT Act provisions. Sending a cease and desist notice through an advocate could further warn him to stop all forms of harassment and defamation. If his behavior continues, you can seek a restraining order from the court to prevent him from contacting you or your family. It’s essential to preserve all evidence of his blackmail, threats, and defamation, and to keep your family and friends informed of the legal steps you’re taking. This legal course should help you address the harassment and regain your peace of mind.
