Is Carding Legal in India? What is Carding and its Legal Consequences?

04-Jul-2024 (In Cyber Crime Law)
I received a message on Telegram about a group offering significant discounts, so I joined and placed an order after speaking with them. Later, I discovered that they were involved in carding, using stolen card details to place orders instead of legitimate coupon codes. I am concerned about my involvement, as my name and phone number are in the order details. Could I face legal consequences for this? What is the punishment for carding in India, and how can I protect myself?

Carding is a serious cybercrime in India and is punishable under multiple sections of the Information Technology Act, 2000 (IT Act) as well as the Indian Penal Code (IPC). While you may not have known that the seller was engaged in carding activities, taking steps to protect yourself and minimize any potential harm is essential.

  1. Monitor Your Credit Card Statements: Regularly check your credit card statements for any unauthorized charges. If you notice any suspicious activity, report it to your bank or card issuer immediately.
  2. Contact the seller:Try to reach out to the seller for more details about the transaction. If they are unresponsive and offer unclear explanations, it could be a sign of fraudulent activity.
  3. Report the Incident: If you suspect you?ve been involved in fraud, contact your bank or credit card provider immediately. They can guide you on how to protect your account and investigate any unauthorized charges.
  4. Change Your Passwords: If you share sensitive information such as passwords or personal details with the seller, change those immediately to prevent unauthorized access to your accounts.
  5. Exercise caution in future transactions: Going forward, only use reputable websites or sellers with strong reviews to reduce the risk of being scammed.
  6. Seek Legal Advice: If you're concerned about potential legal consequences for purchasing from a fraudulent seller, it?s essential to consult a qualified attorney. They can explain your rights and guide you through any legal implications.
Remember, it is always important to be vigilant when making online transactions and protect your personal information to prevent becoming a victim of fraud.

While you may not face direct charges, if a complaint is registered, you could be subject to an investigation. Typically, such activities are only discovered when the perpetrators are caught. So, don’t worry, you’re unlikely to be arrested, but you could still be involved in the case in some capacity. If you were aware that the transaction was related to carding beforehand, your situation could become more complicated.
