Wonderful Trap by Educated Lady 376 2n 376 and 417

03-Apr-2023 (In Criminal Law)
Greetings, Advocates. There is a case involving a woman who claims to have been raped by a man who promised to marry her in May and June. However, there are conflicting statements, as claimant 161 says that no rape occurred in May and June and that she had a consensual relationship with the man in February and March on the promise of marriage. Additionally, claimant 164 does not mention rape or sex in her statement. In the First Information Report (FIR), the promise to marry was made in April 2022, but according to claimant 161, the promise was made over the phone without meeting the man in October 2021. The police have filed a chargesheet stating that the rape occurred in May and June, despite the lack of evidence, including medical evidence and the statement of claimant 161. This case involves a 40-year-old MD doctor.

I think you have lost your mind. Why don't you hire an advocate who will tell you to have patience and face the trial before trial court to prove your innocence. You are unnecessarily asking the same question and give fake mobile number as your contact.

If there is not sufficient evidence on record against the accused then he may file discharge Application before the trial court or he may also go for quashing of chargesheet before the High court under Section 482
