27-Mar-2024 (In Criminal Law)
An NCR was registered against me. And the same was forwarded to my department. Now the complainant withdrew his complaint but Department is sending police station letters to ask the status of NCR. But police is not replying. What can I do in this case. Without confirmation of NCR withdrawal, department will not consider my vigilance clearance. What can I do for this.

Hello please understand this is NCR once it is filed cannot be withdrawn, it is the case where complainant has to go to magistrate court to initiate case. You can always opt for quashing of NCR in High Court

Go directly to the police station firstly then after show them withdraw complaint copy. directly ask them about confirmation and NCR withdrawal. I think they just ask you for give in writing and then after you you will be clear from both the sides

Send an RTI application to concerned police station requesting for the status of NCR. Mention all details of the NCR filed against you such as the No. and date of registration. As a rule umder RTI Act, the concerned dept has to reply to you within 30 days of receiving the RTI Application. Once their reply is received, you can submit the same in your dept.
