WISH TO FILE COMPLAINT UNDER CRPC 200


26-Dec-2023 (In Criminal Law)
I am residing in Delhi now terminated from HPCL my district court is Dwarka. I filed CRPC at Dwarka but it is dismissed as Withdrawn because my lawyer told me that none of the respondent stays in Delhi so criminal complaint will be filed where respondent stays. The respondents stay in Mumbai kindly advise where can I file the criminal complaint. Thanks

A private Complaint under section 200 of criminal procedure code has to be filed within the jurisdiction of a magistrate where the alleged offence has taken place and not at a place where accused resides.

Well, if you have filed a Criminal Case against your Ex-Employer, then, you can file a Private Criminal Complaint at such a place, where, the Crime has taken place and that too, after the Police has refused to register Cognizable Case.
