Will it be a problem in government job if I have a criminal case
25-Jan-2023 (In Criminal Law)
I had an accident few years back in which a 6 month old child died. S 304 and S 277 were filed against me in which they got the settlement and I got acquitted by Lokadalat but did not take the certified copy. Recently I just checked with the police station and they say that complaint of S 304 is still there. I am applying for Govt job and I wanted to know will this create a problem? What should I do now
Apply for a certified copy and furnish the same to concerned Magistrate court for closure of the case..
Since, a criminal matter is supposedly pending against you, there may be a problem as regards disclosure of the same.
Govt. Jobs forms ask for Declaration to that effect.

Well I dont know how you say the matter was settled. One of th sections there are non compoundable which means that you cannot settle the matter unless you go to the High Court in order to have the FIR quashed.
The section 304 A is not compoundable. Present your settlement deed or compromise deed to the court where the case was running. You may get the FIR quashed from high court.
You should check the sections you're quoting they don't quite add up with the facts stated. My guess is that the sections involved are S. 279 and S. 304A IPC. If that is the case, then read further.
Typically the offences that affect one's chances to be recruited in a govt. job are those that involve "moral turpitude or deparavity". 279/304A IPC don't fall under the category of such offences. However, there is no guarantee how this will be perceived by the prospective employer. It depends on the nature of the govt. job in question.
However, please note that in case the truth regarding the ongoing case is not disclosed in the application and is later discovered by the employer on examination or on complaint by anyone, your job will be liable to instantly terminated irrespective of whether the offence involved does or does not involve moral turpitude.

As you have been acquitted, so there will not be any problem for you in taking any sort of government job. You have to do only one thing, take certified copy of the order of acquittal from the concerned court and submit the same to the concerned police station.
