If the investigation has not begun yet, then Police Clearance Certificate will be granted to you. However, if the trial has commenced and the conviction is of more than 2 years then the issuance of the P.C.C is at the discretion of the police. A way out to get PCC is by moving to the Court.

It depends on nature of crime. If crime is small such as traffic violation though the police will refrain from giving a PCC but the High Court can be approached for the same. However if the crime is serious, the police will not grant a PCC and will await decision of the court. should you have any questions please feel free to contact me.

unless your husband has a bail, the pcc will be difficult to get and the possibility of migration will be challenged in the court that your husband may elope there and will not be under the scrutiny of the authorities. It is possible that he might not have a migration possibility at all.

While your husband is in custody, it will be tough to get PCC. PCC is needed for further applying passports etc. PCC will not be given till the time your husband will be acquitted in the matter where he is facing a trial.
