What to do if a partner misuses his power of accessing the bank a/c.

I am a partner of a partnership firm and we are total 4 partners since 2013. Then for use of netbanking we give single sign authority for banking. And msg of transation details on our one partner. And now they miss use of bank a/c through net banking and with cheque book so please give me advise how to i stop this bank transactions. And in our partnership deep no any banking related authority to any single person. Please sugest me.

Dear Sir/Ma'am,

In my opinion, the first step in this scenario should be making a representation to the concerned Bank in writing, expressing your intent to stop any further transactions under the said name as the partnership account is being misused by the said partner. Attach a proof showing you as a partner of the firm. The bank is bound to consider our request.

You can write letter on your firm's letterhead to the bank regarding that and if possible pass a resolution with other 2 partners and attached with the letter to the bank. Ask bank to stop payment. You should proceed for dislution of partnership with the person who is misusing his powers.

rest of the partners can approach the bank and instruct them stop further transactions. you may also give a public notice and issue legal notice to the said partner and point out everything and can cancel his authority by majority
