12-Jul-2023 (In Criminal Law)
What is the punishment of a murder if i kill anybody or a person with shot a weopon or a firearms?
the punishment is for life imprisonment and if the circumstances are rarest of the rare then even death penalty can be given by the court. the police will arrest and investigate on the matter and trial will go on
AS PER SECTION 302 OF IPC THE PUNISHMENT OF MURDER IS LIFE IMPRISONMENT, OR CAPITAL PUNSHIMENT DEPENDING GRAVITY OF OFFENCE, BUT THERE ARE VARIOUS FACTORS/INGREDIENTS OF MURDER WHICH THE RPOSECUTION MUST PROVE BEYOND ANY DOUBT
First of all, don't think of killing anyone whether with a weapon or without. Police are efficient enough to trace you out followed by a long Court battle.
Anyways, if it is for academic purpose then here is some relevant piece of information for your knowledge.
SECTION 300 of the Indian Penal Code defines MURDER: Culpable homicide leads to murder when:
If the act by which the death is caused is done with the intention of causing death, or
If it is done with the intention of causing such bodily injury as the offender knows to be likely to cause the death of the person to whom the harm is caused.
If it is done with the intention of causing bodily injury to any person and the bodily injury intended to be inflicted is sufficient in the ordinary course of nature to cause death.
If the person committing the act knows that it is so imminently dangerous that it must, in all probability, cause death or such bodily injury as is likely to cause death, and commits such act without any excuse for incurring the risk of causing death or such injury as aforesaid.
There are other sections which may also get attracted from case to case basis. But for murder the punishment is defined under section 302 of IPC:
Punishment for murder: Whoever commits murder shall be punished with death, or imprisonment for life, and shall also be liable to fine.
Also read section 506: - Punishment for criminal intimidation: Whoever commits, the offence of criminal intimidation shall be punished with imprisonÂment of either description for a term which may extend to two years, or with fine, or with both; If threat be to cause death or grievous hurt, etc.—And if the threat be to cause death or grievous hurt, or to cause the destruction of any property by fire, or to cause an offence punishable with death or 1[imprisonment for life], or with imprisonment for a term which may extend to seven years, or to impute, unchastity to a woman, shall be punished with imprisonÂment of either description for a term which may extend to seven years, or with fine, or with both.
So, even if you threaten someone with or without a weapon to kill, you may end up in the jail.
