What is the procedure to apply for judicial seperation

sir I'm getting lots of problem from my wife and his family after marriage. and now I want to apply for judicial separation and I want to know that presently we both are staying together can I apply for separation when we both staying together or I can apply when she is at her father home.

if you want judicial separation you have to appoint Advocate and file for divorce. if your wife interested for divorce both can file for mutual consent divorce, if only you want to file there should be cause for filing, you please contact Advocate.

yes, you can apply for judicial separation, even though both of you are staying in the same home. after filing the same either you can shift or she may....

provide me the ground for judicial separation, will guide you accordingly....

You can apply for separation any time.
however once the suit is filed, either you or her has to move out of the house.
if you file now, then your wife can file for residence protection orders and then you will be forced to live in alternative accommodation.
So better to plan every legal step when your wife is away on her own accord at her parental place.
please note that she should go on her own accord. if you throw her out of the house or create a hostile environment making the marital home not conducive for her stay, she will get all the advantage of law and can harass you with Domestic violence and Dowry prohibition cases.
So you need to plan every thing sequentially before moving the court for judicial separation.
