Hello, Advocate Minakshi Ovhal here. After filing of FIR, the chargesheet time limit is 90 days in cases where the offense is punishable with 10 years or more imprisonment and 60 days in other cases. If the chargesheet is not filed within the specified period, then the accused has the right to get bail, which is called default bail under Section 167(2) of CrPC. Thank you.

The maximum time limit to file a chargesheet is:
  • 60 days from the date of arrest for cases triable by lower courts.
  • 90 days from the date of arrest for cases triable by the Sessions Court.
If the chargesheet is not filed within the given period, the accused gets an indefeasible right for bail under default bail provisions.

For those wondering "FIR is valid for how many days?" once an FIR is registered, it does not expire, but the investigation should be completed within a reasonable period, and the chargesheet must be filed within the prescribed time limit as per CrPC.
