What between CRLRC and CRLP case type is filed to challenge issuance of warrant?

17-Jul-2024 (In Criminal Law)
Family court issued NBW against me. Apart from praying for recall of warrants, I want to challenge the family court's decision/step of issuing that NBW also, on law. So my case comes under CRLRC or CRLP for filing in High Court Hyderabad? What is CRLP full form in court?

In legal terms, especially in the Indian context, CRLP commonly stands for Criminal Petition, typically filed under Section 482 of the Code of Criminal Procedure (CrPC). This petition is used to approach the High Court to quash or challenge criminal proceedings, protect individual rights, or prevent abuse of the legal process. While less commonly, CRLP can also refer to the Center for Reproductive Law and Policy, the former name of the Center for Reproductive Rights, the usage depends on context but in Indian courts, it almost always means Criminal Petition.

As such, CRLRC is filed to challenge the order of a lower court issued in CRLMP. As I understand, a warrant has been issued against you (you didn’t disclose for what), and apart from recalling the same, you want to challenge the step of issuing the warrant. In such a case, the proper remedy is to file CRLP under Section 482 CrPC, which invokes the inherent powers of the court to quash criminal proceedings where there is an error apparent or abuse of due process of law. Secondly, CRLRC can be filed before the Sessions Court or High Court, depending on which court passed the order, i.e., Sessions/Magistrate. Bear in mind that CRLP case type can only be filed before the High Court.

CRLP full form is Criminal Petition (Crl.P.) under Section 482 of the Criminal Procedure Code. You can file a petition under Section 482 CrPC seeking to recall the Non-Bailable Warrants issued against you. CRLP full form in High Court remains the same, and it is used for quashing or challenging criminal proceedings.
