Want to register FIR under ipc 496

25-Jan-2024 (In Criminal Law)
she left a day after the marriage...when I went to take her, she refused..so I organized a social meeting ...the girl agreed to come but on condition that she will come after one year. Now it's been 2 years, she is not coming... and now she is claiming to file a false case... Now I came to know that she had cheated and married. Our village was going to be displaced… in which every member was going to get compensation of Rs 14 lakh…this is the reason she cheated for getting membership.

if marriage solmenized under hindu custom. first thing in very first stage you should take appropriate action against of her means you should file section 9 under HMA. in this section you should send proper notice by advocate. after sending the notice you can file the case of conjugal right against your wife.

First of all rather than going legally you should serve your partner a legal notice as to why he/she is doing all these and try to figure out what's going on in his/her mind regarding you. After that if he/she fails to give you satisfactory reply then you can anytime send a complaint regarding your grievances in writing to the police station of your area. But if you are willing to stay with him/her then you should file a petition under section 9 HMA for calling back your partner in your matrimonial life.

Case under section 496 of the Indian Penal Code has a prerequisite to convince the court that the accused was already married at the time of the solemnisation of marriage. The said provision is not for a case where the marriage has been solemnised on fraudulent grounds. Relevant provisions for establishing fraud have to be cited.

If you both belong to Hindu religion than your wife can’t marry anyone until she takes divorce from you, if she has done second marriage without divorce than her marriage is void and is also an offence of bigamy Plz b in touch

We can file a case for either restitution of conjugal rights or otherwise we can prefer a criminal complaint against her followed by registration of FIR against her and before she files any case, we should intend to serve her with a legal notice
