Used unparliamentary words & tried to attack using stone in public
13-Jan-2023 (In Criminal Law)
Divorce case is pending in court. My wife filed. They ask for court order to see child.I informed my wife through SMS that I wanted to see my daughter.I went infront of their office on the mentioned date & parked my bike near road. Her father asked me why are you here.i said 'to see my daughter'.He said 'ur daughter? U cant see her' & started using unparliamentary words in public& even tried to attack using stone infront of others on the main road. I immediately complained to the men PS.After this FiL alongwith my wife tried to file case against me in Women PS by saying "he is sending SMS & coming to our place".He showed more interest in filing case & action against me .Shall I proceed to file FIR against the complaint I lodged?
You have a good opportunity. Your father in law and wife defamed you in public and it also amounts to cruelty. Sending SMS to see your child is not a crime. If you want to protect yourself and your family members you have to go ahead with your complaint until the end. The said incident happened in public. You have all rights to meet and interact with your child.
if you want to see your then file a petition for child custody and visitation rights because your wife catch the legal power to have the child below 5 years as provided by the law and even after 5 years she has unless it is disturbed by the court of law where is to approach the court for child custody and visitation right is suggested you are wife's workplace or any other place then police will file case against you for harassment and for causing nuisance empowered with legal protection you should approach the proper court and with the consent of your wife or with the judgement of the court only you can see the child file an FIR against your wife regarding the child custody because both are natural guardian and all other all to have the legal right Peculiar child
